In het rapport dat Teeven de Inspectie Veiligheid en Justitie over de zaak liet opstellen, wordt geconstateerd dat medewerkers van de Immigratie-en Naturalisatiedienst (IND) belangrijke wijzigingen in de asielstatus van Dolmatov niet adequaat hebben verwerkt in het elektronisch registratiesysteem van de dienst.
Teeven onderschrijft die conclusie volledig, maar stelt dat voor het inspectieonderzoek naar de zaak-Dolmatov nooit eerder is gebleven dat dit vaker gebeurde. Er zijn volgens hem niet eerder structurele signalen van niet-naleving geweest.
The CPT considers that the current staffing level as regards general practitioners is not sufficient for an establishment with a capacity of 600 detainees and which was accommodating some 450 persons at the time of the visit indeed, the delegation received a number of complaints from the detainees concerning delayed access to medical care. Under the circumstances just described, the Centre requires at least 1.5 FTE posts of medical doctors. The Committee recommends that the medical staffing level be increased accordingly.
The delegation was informed that a number of detainees had been diagnosed with severe psychotic disorders such as schizophrenia, severe personality disorders, mental disability and PTSD. Many detainees also suffered from anxiety disorders or mild to moderate depressive conditions. For at least some detainees, the Centre did not offer the possibility to deploy the necessary care and treatment. The CPT wishes to underline that persons requiring psychiatric assessment and/or treatment, whatever their legal status, should preferably be assessed and/or treated in a suitably equipped and staffed medical facility. The Committee recommends that measures be taken to transfer detainees suffering from the most severe forms of psychotic disorders to an appropriate psychiatric facility.
Further, detainees diagnosed with severe psychiatric disorders but who are in remission should benefit from a special regime of activities conducive to their psychosocial rehabilitation, including more out-of-cell time.
In the course of the visit, the CPTs delegation held consultations with Ivo Willem OPSTELTEN, Minister of Security and Justice, and Fredrik TEEVEN, State Secretary of Security and Justice. It also met senior officials from the Ministry of Security and Justice, the Ministry of the Interior and Kingdom Relations, the Ministry of Defence, and the Ministry of Health, Welfare and Sport. Further, meetings were held with representatives of various national inspectorates (IST, IGZ) and monitoring (CITT) and advisory committees (RSJ).
